Folders.com can re-quote a job at the time of submission if the artwork or other input materials do not conform to the information on which the original quotation was based. Stock or standard material changes may occur due to changes in vendors, mills, or other third parties. Customers should request the appropriate proof to justify material specifications. Pre-Press proof terms are applicable. Folders.com is not responsible if material appearances provided on the website(s) differ from actual material appearances.

Artwork, type, plates, negatives, positives, and other items when supplied by Folders.com shall remain their exclusive property unless otherwise agreed in writing.  Sketches, copies, mock-ups, and all preparatory work created or furnished by Folders.com, shall remain their exclusive property and no use of the same shall be made, nor any ideas obtained there-from be used, except upon compensation to be determined by Folders.com.

Electric Media/Materials

It is the customer’s responsibility to maintain a copy of the original file. Folders.com is not responsible for accidental damage to media supported by the customer or for the accuracy of furnished input or final input. Any additional translating, editing or programming needed to utilize customer-supplied files will be charged at prevailing rates.

Alterations include all work performed in addition to the original specifications. Such additional work shall be charged at current rates. Additional charges will be properly documented.

Prepress Proofs

If requested, proofs will be submitted with an original copy for the customer's review and approval. It is the customer’s responsibility to check the proof carefully and to notify the Folders.com team immediately of any errors. It is crucial that the customer checks every detail including, but not limited to, correct fonts, images, spelling, punctuation, logos, addresses, phone numbers, emails, web addresses, missing images, missing text, company name, positioning of all items, etc. Corrections are to be made on the “master set” and on the proof form(s), then returned to the Folders.com team, marked “As Is” or “Changes Required” and signed by the customer. The Folders.com team must have the customer’s approval in writing on our proof form before we can proceed with the order.

If additional proofs are desired, requests must be made when proofs and/or proof forms are returned. Folders.com regrets any undetected errors that may occur in the finished product
but will not be held responsible for those errors if they were evident on the proof approved by the customer. Folders.com shall not be responsible for errors if the customer has not ordered
or has refused to accept proofs or has failed to return proofs with an indication of changes or has instructed the Folders.com team to proceed without submission of proofs or proof
waiver. The customer’s approval and signature on our proof form, or waiver of proof either verbally or in writing, is evidence of the customer’s acceptance of all artwork and/or production specifications and is legally binding. By the customer’s signature on the quote and/or order form, the customer agrees to these terms.

Press Proof

Unless specifically provided in the Folders.com team’s quotation, the costs for press proofs will be charged to the customer at current rates. Any changes, corrections, or lost press time due to the customer’s change of mind or delay will be charged for at current rates.

Color Proofing

A color proof is used to simulate how the printed piece will look. Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operation, a reasonable variation in color between color proofs and the completed job is to be expected and shall constitute acceptable delivery.

Overruns or Under Runs

Overruns or under runs not to exceed 10% on quantities ordered up to 10,000 copies and/or the percentage agreed upon over or under quantities ordered above 10,000 copies shall constitute acceptable delivery. Folders.com will bill for the actual quantity delivered within this tolerance. If the customer requires guaranteed “no less than” delivery, the percentage tolerance of coverage must be doubled and charged at prevailing rates.

Scheduled delivery dates are not guaranteed based on customer delays in the artwork, order, proofing and uncontrollable delays from subcontractors or freight carriers, or environmental effects.  Unless otherwise specified, the price is quoted for a single shipment, without storage.  Order pricing is based on continuous and uninterrupted delivery of the complete order, unless specifications distinctly state otherwise. Charges related to delivery from the customer to Folders.com, or from the customer’s supplier to Folders.com are not included in any quotations unless specified. Special priority or pickup or delivery service will be provided at current rates upon the customer’s request. Materials delivered from the customer or his suppliers are verified with delivery tickets as to cartons, packages, or items shown only. The accuracy of quantities indicated on such tickets cannot be verified and Folders.com cannot accept liability for a shortage of supplier’s tickets. Titles for finished work shall pass to the customer upon delivery, to the carrier at the shipping point, or upon mailing of invoices for finished work, whichever occurs first.

No use shall be made, except by written permission of Folders.com for all use of this work and for any derivation of ideas from it and compensation (if any) to be determined by Folders.com.

Customer-Furnished Materials

Paper Stock, camera copy, film, color separations, and other customer-furnished materials shall be manufactured, packaged, and delivered to Folders.com specifications. Additional costs due to delays or impaired production caused by specification deficiencies shall be charged to the customer. The customer-supplied paper must be delivered according to the specifications furnished by the provider. These specifications will include correct weight, thickness, pick resistance, and other technical requirements. Creating Effective Terms & Conditions for Websites

Terms & Conditions are a crucial aspect of any website, providing legal protection for website owners, setting expectations for users, and establishing guidelines for website usage. This article will delve into the importance of creating clear and concise Terms & Conditions that are legally compliant and user-friendly. By understanding the key components, legal compliance requirements, and user-friendly design principles, website owners can ensure that their Terms & Conditions effectively protect their interests and provide a positive user experience.

Importance of Terms & Conditions

Terms & Conditions serve as a legal contract between the website owner and users, outlining the rules and guidelines for using the website. By clearly defining the terms of use, website owners can protect themselves from potential legal disputes and liabilities. Additionally, Terms & Conditions help set expectations for users regarding their rights and responsibilities while using the website. This can help prevent misunderstandings and ensure a positive user experience.

Legal Protection for Website Owners

One of the primary reasons for having Terms & Conditions is to protect the website owner from legal issues. By clearly outlining the rules for website usage, owners can establish their rights and limitations, reducing the risk of disputes with users. In the event of a legal dispute, having well-drafted Terms & Conditions can serve as evidence of the agreed-upon terms between the parties.

Setting Expectations for Users

Terms & Conditions help set clear expectations for users regarding what is allowed and what is not allowed when using the website. By outlining the rules and guidelines upfront, users can understand their rights and responsibilities, reducing the likelihood of misunderstandings or conflicts. This can help create a more transparent and trustworthy relationship between the website owner and users.

Establishing Guidelines for Website Usage

Terms & Conditions provide a framework for how the website should be used, including rules for content, user behavior, and interactions. By establishing clear guidelines, website owners can maintain control over the website environment and ensure that users are aware of the expectations. This can help create a safer and more secure online experience for all parties involved.

Key Components of Terms & Conditions

When creating Terms & Conditions for a website, there are several key components that should be included to ensure clarity and effectiveness. These components help define the rights and responsibilities of both the website owner and users, as well as establish the rules for website usage.

Introduction and Acceptance of Terms

The Terms & Conditions should begin with an introduction that explains the purpose of the document and how it applies to the website. Users should be required to accept the terms before using the website, either by checking a box or clicking a button. This ensures that users are aware of and agree to the terms before proceeding.

Definitions of Key Terms

It is important to define key terms used in the Terms & Conditions to avoid confusion and misinterpretation. By clearly defining terms such as ""user,"" ""content,"" and ""intellectual property,"" both parties can have a common understanding of the language used in the document.

User Obligations and Responsibilities

The Terms & Conditions should outline the obligations and responsibilities of users when using the website. This may include rules for creating an account, posting content, interacting with other users, and complying with applicable laws. By clearly defining user responsibilities, website owners can maintain a safe and respectful online environment.

Limitation of Liability

It is important to include a limitation of liability clause in the Terms & Conditions to protect the website owner from legal claims. This clause limits the owner's liability for any damages or losses incurred by users while using the website, within the bounds of the law. By clearly outlining the extent of liability, website owners can reduce their risk exposure.

Dispute Resolution

In the event of a dispute between the website owner and users, the Terms & Conditions should include a section on dispute resolution. This section outlines the process for resolving disputes, such as through mediation, arbitration, or litigation. By providing a clear process for resolving conflicts, website owners can avoid prolonged legal battles and reach a resolution more efficiently.
